Terms of Service

Written to be read. Who you are dealing with, what you are paying, what we are responsible for and what you are, and the New Zealand consumer rights that override anything on this page.

You can verify the company independently and for free on the New Zealand Companies Register at companies-register.companiesoffice.govt.nz. We publish the number so you can check it rather than take our word for it — the register records that the company exists and who its directors are, which is a different thing from any government approval of the product, and we do not claim the latter.

1. What GoCushy is, and is not

GoCushy provides checkout and automation software. You sell your own products to your own customers.

Payments are processed by Stripe — or PayPal or Airwallex where you connect them — directly into your own account. GoCushy never holds your money or your buyers’ money at any point.

This has a practical consequence worth stating plainly: you are the seller of record, not us. You are responsible for delivering what you sell, honouring your refund policy, and complying with the laws that apply to your products and your buyers. It also means that if GoCushy stopped working tomorrow, your payment processor account, your customer relationships and your money would all still be yours.

In New Zealand, GoCushy is NZ$99 per month including GST (NZ$86.09 plus GST), or NZ$950 per year paid annually. The first 30 days are free. Everything is included; there is no feature tier and no per-seat charge.

GoCushy adds a 0% platform fee. Your payment processor still charges its own published rate, on your own account, exactly as it would without GoCushy. Those fees belong to the processor and never pass through us.

Prices are shown in New Zealand dollars and include GST at 15%. We will give at least 30 days’ notice before changing the price of an existing subscription, and you may cancel before any change takes effect.

A note on our other market. GoCushy is also sold outside New Zealand, in United States dollars, on different terms. Those terms are not this offer and do not apply to a New Zealand subscription. If you are in New Zealand, this page is the one that governs what you pay.

4. Your rights as a New Zealand customer

If you acquire GoCushy as a consumer, the Consumer Guarantees Act 1993 gives you guarantees that cannot be contracted out of, including that the service will be supplied with reasonable care and skill and will be reasonably fit for its purpose. The Fair Trading Act 1986 prohibits us from misleading you about what the product does or what it costs.

Nothing on this page limits those rights. Where anything here conflicts with them, those Acts win.

If you acquire GoCushy for the purposes of a business, sections 43(2) and 5D allow those guarantees to be contracted out of by agreement, and to the extent permitted by law they are excluded for business customers. This is the ordinary position for business software and we state it plainly rather than burying it.

Cancelling. You can cancel at any time from your dashboard. Cancellation takes effect at the end of the period you have paid for; we do not pro-rate part months. During the free trial you can cancel without being charged at all.

5. Acceptable use

You may not use GoCushy to sell or promote:

Nor may you abuse the platform itself: no bypassing fees, probing or attacking the infrastructure, reselling access without agreement, or using another merchant’s data. We may suspend accounts that breach this, and we report unlawful activity where required.

The third bullet is not boilerplate. A countdown that resets, or a testimonial nobody gave, is conduct the Fair Trading Act reaches — and it would be ours to answer for as well as yours if our software made it easy. It does not: expired deadlines vanish rather than resetting, and prices are computed on the server from your configuration, never from what a page sends.

6. Availability

GoCushy is provided as it is. We work hard to keep it available and correct, but we do not guarantee uninterrupted service, and we may change or discontinue features with reasonable notice. Features still in development are labelled as such.

We publish a status page and we would rather tell you about a problem than have you discover it.

7. Liability

To the maximum extent permitted by law, Daom Limited’s total liability arising from the service is limited to the fees you paid us in the three months before the claim. We are not liable for indirect or consequential losses, or for the acts of merchants, buyers, payment processors, or AI agents connected by users.

Nothing in these terms excludes or limits rights that cannot be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply to you.

8. Ending it

You may close your account at any time. We may suspend or terminate an account for breach of these terms, with notice where practicable.

On termination your payment-processor account and the funds in it remain yours — they were never ours. An export of your order data is available on request for 30 days.

9. Handling your buyers’ data

For your buyers’ personal information, you are the agency that controls it and GoCushy processes it on your behalf. We process buyer data only to operate your checkouts, deliver receipts and access, run the automations you configure, and keep your sales records.

Never for our own purposes: no marketing to your buyers, no benchmarking or analytics about you, and never to train or improve any AI model.

We use the processors listed in the Privacy Policy, notify you without undue delay of any breach affecting your buyers, and delete or return buyer data when your account closes. Sending marketing email through a connected email platform is your responsibility under the laws that apply to you, including the New Zealand Unsolicited Electronic Messages Act 2007.

10. Support access to your account

GoCushy is run by a very small team. To answer support questions, investigate payment problems and fix bugs, an internal admin area can be opened that shows merchant account details and order records — which include your buyers’ email addresses and purchase details.

That area is read-only. Nothing in it can change, refund, delete, send, or otherwise act on your data, and there is no way to log in as you. It never shows your Stripe, PayPal, Xero or other credentials — only the provider name and whether the connection is live.

Every time it is opened, an entry is written to an activity trail recording what was viewed and when. It cannot be opened at all unless two-factor authentication is on for that account.

11. Governing law

These terms are governed by the laws of New Zealand, and disputes are subject to the exclusive jurisdiction of the New Zealand courts. That is not a concession we made for this page — it is where the company is, and it has always been the position.

Changes to these terms

We will post any change here with a new date, and give at least 30 days’ notice of a change that materially reduces your rights or increases what you pay.
